Can anyone help me? I've just lost my appeal for Esa and need some advice where to go from here.
I have been on I.s. (now Esa) since 1996 suffering with 2 collapsed discs and three prolapsed discs in my lower back, and osteoarthritis in my left knee.
I am now, apparently, fit for work but am clearly not( even my doctor agrees)
I know I can start a fresh claim if my condition has worsened (and it has) but I dont want to go down that route as I will lose the backpay they owe me while the appeal process has being bumbling along and its quite a bit.
I cannot say that the tribunal did not follow the rule of law but its this way they only look at what your condition was, not what it is now, even if you have been informing the ESA department of your changes of condition. Any help would be grateful Tim.
